KEY RESPONSIBILITIES:
Pre-Contract Management & Negotiation (Primary Focus):
Contracts professional with a proven track record in preparing, modifying, negotiating and finalizing a wide range of agreements for main contractors and design and supervision consultants.
Thoroughly review and interpret various contract documents, with a strong emphasis on FIDIC Red Book (Construction) conditions, ensuring deep understanding and application to real-world scenarios and securing favourable terms for the company
Proficient in preparing various contract documents including work orders, letters of acceptance, LOIs, LONs, MOUs, NDAs, joint venture agreements, framework agreements, consultancy agreements, and supply agreements.
Actively participate in the negotiation and finalization of Main Contractor agreements and consultancy agreements, ensuring favorable terms and conditions for the company.
Contractual Documentation & Compliance:
Assist in the preparation of tender and contract documents, ensuring clarity, completeness, and adherence to company standards and legal compliance.
Extensive experience in handling contract-related matters, including the preparation of notices of termination, default notices, side agreements, and amendments to contracts for main contractors.
Skilled in attending high-level meetings to discuss contract administration risks and recommending effective mitigation measures through the drafting of clauses.
Prepare and review contractual instruments such as Assignments, Novation Agreements.
Examine and verify the enforceability of Bank Guarantees (e.g., performance bonds, advance payment guarantees) and other security instruments from the contractors.
Risk Mitigation & Dispute Avoidance:
Identify potential contractual risks and liabilities during the pre-contract and early contract phases, proposing effective mitigation strategies.
Develop and implement strategies to prevent potential disputes, fostering a collaborative environment from the outset.
Possess a foundational awareness of dispute resolution mechanisms (e.g., litigation, arbitration) to understand their implications in contract drafting.
Collaboration & Support:
Work closely with internal stakeholders including Project Team, Legal, Procurement, and Finance teams to ensure seamless contract administration.
Provide expert contractual advice and guidance to project teams on contractual matters.
Assist in the development and enhancement of company-wide contract templates and policies.
KEY REQUIREMENT:
Bachelor’s degree in quantity surveying, Civil Engineering, Construction Management, or related field.
Minimum 8–12 years of experience in contracts and procurement, with at least 5 years in the UAE real estate/construction industry.
Proven experience managing contracts for high-rise residential or mixed-use developments.
Excellent negotiation, communication, and stakeholder management skills with superior written and verbal communication skills in English.
Demonstrable in-depth knowledge and practical interpretation of FIDIC Red Book conditions is essential.
Familiarity with local laws and regulations pertaining to construction and real estate in the UAE.
